Universal Terms of Service
This Agreement ("Agreement") is by and between Pixel Equity, Inc. ("Pixel"), a New York non-profit corporation, and you, your heirs, agents, successors and assigns ("You"), and is made effective as of the date of electronic execution. This Agreement sets forth the terms (“Terms”) and conditions of Your use of
Pixel services ("Services").
This Agreement as well as any additional Pixel policies, together with all modifications thereto, constitute the complete and exclusive agreement between You and
Pixel concerning Your use of Pixel’s Services, and supersede and govern all prior proposals, agreements, or other communications. All
Pixel policies and agreements specific to particular Services are incorporated herein and made part of this Agreement by reference. By engaging in
Pixel’s Services, You acknowledge that You have read, understood, and agree to be bound by all terms and conditions of this Agreement and any other policies or agreements made part of this Agreement by reference, as well as any new, different or additional terms, conditions or policies which
Pixel may establish from time to time, and any agreements that Pixel is currently bound by or will be bound by in the future. You agree that any contribution or donation, financial or otherwise, made to attain a specific game, console, accessory, or other item may not be used to purchase said item and that the contribution or donation is non-refundable. In addition to transactions entered into by You on Your behalf, You also agree to be bound by the terms of this Agreement for transactions entered into on Your behalf by anyone acting as Your Agent, and transactions entered into by anyone who uses the account You've established with
Pixel, whether or not the transactions were in Your behalf. You agree that Pixel may modify this Agreement and the Services from time to time. You agree to be bound by any changes
Pixel may make to this Agreement when such changes are made. If You have used Services from
Pixel, the term of this Agreement shall continue in full force and effect. You agree that
Pixel shall not be bound by any representations made by third parties who You may use to use Services from
Pixel, and that any statement of a general nature, which may be posted on Pixel’s Web site or contained in
Pixel’s promotional materials, will not bind Pixel.
By using Pixel Services, you acknowledge and agree that Pixel may access, preserve, and disclose your account information and any Content associated with that account if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce the Terms, including investigation of potential violations hereof, (c) detect, prevent, or otherwise address fraud, security or technical issues (including, without limitation, the filtering of spam), or (d) protect against imminent harm to the rights, property or safety of
Pixel, its users or the public as required or permitted by law.
You understand that the technical processing and transmission of Pixel Services, including your content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks, devices or services.
